Getting yourself arrested can come as a surprise. This is especially true when you are a good law abiding citizen and getting arrested is the last thing that you expected to happen.

Having the police come for you with an arrest warrant or even just arresting you on suspicion of doing something that you haven’t done can be a very scary experience and it happens to thousands of people every year. When it happens to you will you know what to do? Will you know how to handle the situation in a way that doesn’t incriminate you?

Most of us, and I’m guessing you too, would assume that cooperating with the police was the best thing to do. Answer all their questions as truthfully and as honestly as you can. It pains me to have to tell you that this is exactly what you should not do.

Do not say anything

When you get arrested you will be told that you don’t have to say anything if you don’t want to but if you do say something then it can be used against you in court. Read that again – “It can be used against you” – and believe me, if they can use it against you then they will.

In the UK the police are much less honest than than US cops. They fail to tell you about the danger that you put yourself in when you talk to them. In fact they encourage you to incriminate yourself by suggesting that if you don’t say anything then you won’t be able to rely on it in court. As if you have to tell them everything or you will be in big trouble. Be quite clear on this point. If you tell the police anything then it is very likely that it will be held against you when you go to court. So don’t say anything.

Get yourself a lawyer

If you are going to say anything at all to the police then make sure that your legal council is present at all times. This will help you to avoid some of the more blatant traps that the police will place for you in their questioning. It is very difficult to stop yourself from saying something that will later get you into trouble. Often you will not be aware of the intent of the questions being put to you. The interviewers are skilled at what they do and are well rehearsed in their questioning techniques.

You might not know this but when you get to court they can use any part of your statements against you and they do not have to quote the whole conversation. Quotations from your statements can and do get used out of context to make you look bad when the answers you gave to questions seemed quite safe at the time when you said them.

Don’t be stupid. When you get arrested don’t say anything then they will not have anything that they can use against you. It’s that simple.

Never touch a police officer

if you find yourself being arrested by a police officer don’t protest, don’t shout and curse and above all do not touch the officer. If you do any of these things it can get you arrested when they were not going to arrest you. It can also get you arrested on more serious charges than you might otherwise have been. These extra charges can include resisting arrest and assaulting a police officer. You do not want to add these charges to your arrest record but the officers will love it if you do. They get more points if they can arrest you on more serious charges.

Never refuse legal council

It is not uncommon for people to refuse legal council when they get arrested, even when the service is free. The right to a lawyer is often waived by innocent people who believe that they have nothing to fear from the justice system providing that they answer all the police questions truthfully and honestly. They have nothing to hide do they? Nothing could be further from the truth. Do you think that the police are interested in the truth or in finding the real criminal if you are sitting in front of them prepared to give them all the evidence that they need to convict you?

The police are interested in increasing their conviction rate. They have no incentive to ensure that they put the right people behind bars, despite anything that you might see in films or on TV.

The police are not your friends

If they police arrest you then they are not your friend. They are not on your side. They will do everything that they can to gather evidence against you that might lead to your conviction.

Police investigators are experts in getting you to say exactly what they want you to say and they want you to say something that they can use against you in court. Don’t tell them anything.

it’s your public duty to say nothing

If you talk to the police then you are potentially giving them the evidence that they can use to convict you with. If they have that evidence then they will lose any incentive that they might have had to look for the real criminal. If you talk to the police they could convict you and the real offender will remain free to commit more crimes. It is your public duty to not let this happen. Make the police do their job and find the truth instead of making it up.

You can often avoid getting yourself arrested by handing yourself in before the police come to arrest you. If you do this voluntarily and under the supervision of a lawyer then you have a much better chance of dealing with the warrant without getting arrested. Recent technology advances in the field of forensic science have brought about a rash of convictions based on detecting suspects involved cases that have been cold for years. Most notable of these advances are in the field of DNA profiling where your DNA can be matched to that found at scenes of crimes that were committed decades ago. This, together with the alarming passion with which police officers now collect peoples DNA for entry into national computer systems, has resulted in many recent cold cases of murder and rape being tried before a judge and convictions obtained.

If you get arrested in the UK and in many parts of the USA too, then you will almost certainly have to submit to your DNA being taken and entered onto the database. You don’t have to be charged with anything for this to happen and it doesn’t matter what you were arrested for either. Once your DNA profile is on the database it will be searched for matches and if one turns up then you are in a lot of trouble whether you committed a crime or not. Remember that the police only need “probable cause” to lawfully arrest you and that can mean that they don’t have much more than suspicion.

Throw the rapists and murderers into prison

I would like to think that all of the convictions obtained in this way have been sound and we can all sit back and look on this as a job well done with more criminals behind bars. There is one recent case however, involving a friend of mine, that has given me cause to doubt this. It has in fact terrified me because it demonstrates just how easy it is for any one of us to get convicted and sent to prison for something that you did not do.

I’m sure that there are now many more bad people in prison as a result of these new technologies. You often hear of cases where the defendant had a string of prior offenses similar to the one they are currently accused of or where eye witnesses remember the person. There are also cases where factual evidence and motive lead you to believe that the guilty verdict is the right one.

But what if there is no evidence?

What if the only evidence in say a rape case, is a DNA match? At best, a DNA match proves that sex took place within 72 hours of the sample being taken. What if the defendant has no prior convictions for any offence and convincingly argues that he has no memory of committing an offence?

What if the police have already destroyed all the other evidence, including the alleged victim’s clothing and hair from bushes. Destroyed to save space in the evidence store would you believe?

What if the defendant has never been identified as the attacker by anyone and all the prosecution witnesses contradict the alleged victim on most of her account of the event? The alleged victim was an alcoholic and a drug addict. Not the most reliable of witnesses.

What would you do if you were the prosecution?

If you were responsible for the prosecution case in this instance what would you do? Would you accept that there is no evidence to suggest that the defendant is guilty of any crime? Indeed there was no real evidence that a crime was committed at all by anyone so would you drop the case or would you take it to court and expect an unqualified jury to decide? Decide on what You might ask. If there is no evidence then what is the jury supposed to do?

This could happen to you

This story might seem absurd and unbelievable to you as it did to me but this is exactly what happened to a friend of mine. The same thing could happen to you or I just as easily. He has no memory of the event which happened 16 years earlier and is quite sure that he would have remembered committing such a crime.

All 12 jurors in this case decided that he was guilty of the crime beyond all reasonable doubt. How can that happen when there is no evidence? Perhaps they assumed that if there was absolutely no proof whatsoever and the police still believe that he did it then they must know something that the jury could not be told for some legal reason. Just a theory, what do you think?

How do I avoid giving up my DNA?

My friend was forced to give up his DNA when he was arrested for a misdemeanor where no charges were brought. Regularly checking for arrest warrants is one way that you can reduce your chances of getting arrested and having your DNA sampled. You can do this inexpensively using a public records web site. If you have an outstanding arrest warrant and you give yourself in voluntarily then you are much less likely to be arrested and find yourself on the DNA register.

It may not be politically correct for any police force to say that their prime objective is to make as many arrests as possible but what do you think motivates the cops on the street? I’m sure that they get good reports for making arrests and they know how to check if you have an active arrest warrant. Think about that for a moment and you will see that asking a police officer to do a check for you is not a good idea. There is a much better way to check for your warrants.

Knowing how your police department works is very important. It exists to investigate and detect crime and then to arrest the perpetrators of those crimes. It makes sense to measure their performance to make sure that they are doing the best job for you and reward them appropriately for doing it. The problem with this is that it creates an eagerness to arrest people that fosters a competitive attitude towards arrests. Police officers could become more interested in maximizing arrests than detecting and preventing real crime.

How do you measure the performance of a police officer?

I’m guessing that there are many things that police forces use to asses the performance of their officers. This could include recording the accuracy and speed of their paperwork, their proficiency with weapons and a host of other things. It would be very naive to imagine that the number of arrests made by by an officer is not included in the assessment.

Measuring arrest numbers is easy

It’s almost too easy to to count the number of arrests made and I’m sure that they make it more interesting by awarding more or less weight depending on the severity of the crime. Was it a misdemeanor or a felony? Busting someone for a felony is sure to prompt a celebration don’t you think? It must be worth many points on the arrest tally sheet.

Police officers can check if you have an arrest warrant

So cops are measured by how many arrest that they make. They can also check to see if you have a warrant so what do you think is the first thing they do when they stop you for any reason? They will check to see if you are wanted of course.

Problem solved you might think. All you have to do to check for arrest warrants is ask a police officer. But there is a catch. A police officer will be only too pleased to do an arrest warrant check on you and they will do it for free too. The problem is that they will arrest you on the spot if they fid that you have a warrant.

Remember the game that the cops play involves arresting as many people as possible in as short a time as possible. Finding out that you are wanted represents an easy score for them.

You do not want to get arrested

Believe me when I tell you that the last thing you want to happen is to get yourself arrested. This aplies whether you have committed an offence or not. Getting arrested means spending some time in jail and the possible expense of bail. It also means that you will have an arrest record that will never go away. For many employers, having been arrested is reason enough not to give you a job. It won’t count for much that you were never convicted or even if you were never charged with anything. The fact that you show up on police records is enough to condemn you to a life of low paid work.

I say “free” but you might find that you need to pay some kind of administration fee depending on how you obtain the records information. There seems to be a growing culture amongst law enforcement agencies to collect DNA from everyone that they can. This is being made possible in more and more areas by laws which allow DNA to be taken and stored from anyone who gets arrested. Did you think that you had gotten away with that warrant for your arrest because it was issued a long time ago? Perhaps it was even in a different state. If you haven’t been arrested already then perhaps the warrant has been forgotten about – Wrong. How long does an arrest warrant last for? – A lot longer than you might imagine.

Arrest warrants are for life

Warrants do not expire and they do not have a time limit. An arrest warrant will remain active until you get arrested or you give yourself up. It’s as simple as that and if you haven’t been arrested yet then it’s just luck. Give it time and it will most likely catch up with you.

If you have a warrant for a serious felony crime then you can expect to be caught quickly unless you are actively avoiding capture. The jury system is supposed to be the best form of justice that you can get. By getting 12 ordinary people to determine guilty or not guilty we protect ourselves from possible corruption within the system itself, or do we? A man was recently found guilty of a rape that happened 16 years ago, by a jury in the UK that sent him to prison for 6 years. The only problem with this is that in my opinion, there was no proof that the defendant actually committed the offence. In fact there was no evidence to prove that he was even there when the incident happened or that if he was that he attacked the woman. There was no evidence to prove that an attack even took place. So how did a jury determine that he was guilty beyond all reasonable doubt?

“How could this happen?” I hear you say. You might rightly think that the innocent have nothing to fear from the law and that it could never happen to you? Well this case shows that this just isn’t true, it could happen to you which is why it is so important that you avoid getting arrested. Checking for arrest warrants regularly is one way of reducing your risk of becoming another mistake of justice.

If you are a man you should be afraid – be very afraid

Anyone who gets arrested in the UK now must submit to the police taking a sample of their DNA for entering onto the national DNA database. Many people believe that there is now a policy of arresting people for the sole reason of collecting DNA for the database. This policy can be seen in action when people get arrested for offenses that would only have warranted a telling off from a police officer 20 years ago.

This policy of arrest to collect DNA is spreading fast in the US and it looks like it will overtake the UK database very soon. On the face of it you have nothing to worry about unless you have committed a crime but this is far from reality I’m afraid.

Does a DNA match mean that you are guilty? It seems that it does

The UK case that I am referring to was an alleged rape of a woman which happened 16 years before the defendant was arrested and his DNA taken. The DNA sample was matched to the that found on the alleged victim when she reported the incident to the police 16 years earlier.

This makes the defendant a suspect and he accepted that he must have had a one night stand with the alleged victim but he has no memory of either the event nor the woman. He was very insistent that he could not have committed this crime because he knows that he has never raped anyone. He would have remembered the event had he done so. I know that I would have.

Experts testified that the DNA sample could have been deposited at any time up to 3 days before the alleged incident. No evidence to place the defendant at the scene was produced and the defendant was never identified as the attacker. There wasn’t even any proof that there was any attack on the woman at all.

These are the only facts that are known in the case and the jury were instructed that they must find the defendant innocent if they were not absolutely certain that he committed the offence. The jury were also told that the alleged victim had claimed to be the victim of rape on 2 previous occasions, she had a drug habit and none of the prosecution witnesses could agree on vital facts.

The defendant had never before been in trouble with the police for any offence and was of good standing in the community with a partner and 2 adorable small children.

Can you trust a jury?

Why did all 12 members of the jury decide that he was guilty beyond all reasonable doubt? In my opinion they did not base their decision on the facts which was their job. Instead they voted with emotion after hearing the prosecution make up a fictitious story about how the defendant committed the offence. This story had no basis in fact at all.

Don’t get arrested on a warrant – Keep your DNA to yourself

Don’t believe the lie that the innocent have nothing to fear from the law. You and I have a lot to fear. In fact I now fear the justice system more than I fear the criminals. My advice to you is to avoid getting arrested. If they don’t collect your DNA then they can’t match you to a cold case with such ease.

Avoid the police whenever you can. Don’t let them even see you. If they can’t see you then they can’t arrest you. Check for warrants for arrest regularly and deal with them as quickly as you can. This will avoid getting arrested unexpectedly on a routine traffic stop or when the police call at your home with the warrant. You can check for arrest warrants using a public records investigations web site. The peace of mind this can give you is worth far more than the small fee that they will charge you.

Antony is a shy kind of guy who works in a bank. He isn’t a high flyer but he knows his job very well and if he keeps his record clean he will surely progress through the ranks into a well paid position someday.

Antony is well aware of the dangers and problems that can be caused by identity theft so he routinely takes steps to avoid it happening. He shreds everything with his name or address on it. He shields his hands at the ATM machine and he never gives away any information when someone calls him on the phone. He’s never been in trouble with the police so why did the cops wake Antony up in the middle of the night banging on his doorwith an arrest warrant?

It happened more than 2 years before the police came for Antony. He would usually work through his lunch hour at his desk but it was such a beautiful day he decided that for once he would take a walk in the park instead. He was feeling very daring that day so he took one of the towels from the bank washroom to sit on the grass without getting his suit dirty.

Antony found a nice spot, lay down his towel then sat on it. It was so hot that day that he couldn’t help himself lying down for just a moment to relax. It wasn’t long before Antony was asleep and he stayed that way for a good 15 minutes. He had been working so hard and he deserved a little de-stressing time. When his lunch hour was up he picked up the towel and returned to the office.

What Antony will never know is that someone picked his pocket while he was asleep that day. The thief was wearing a suit and had his own blanket to sit on. He had been waiting for someone like Antony to appear on such a nice day. When the thief saw Antony lying asleep he couldn’t believe his luck. Picking his wallet out of his pocket and replacing it was no problem at all to him. He didn’t steal anything so Antony will never know that it happened.

Antony had just had his identity stolen. The thief got away with his credit card numbers, his address and his bank employee number. More than enough to enable the thief to impersonate him.

How to get into trouble without doing anything wrong

If someone gets caught committing a crime then gets let out on bail and disappears, the court will issue a Bench Warrant. If the criminal gave the police your name instead of their own then the Bench Warrant will be made out for your arrest and not for the real criminal. Scary isn’t it?

Now the thief that stole Antony’s identity had never planned to get caught but he had planned escape routes to use if he ever did get caught. In this case his escape route was Antony’s identity and it worked beautifully. He managed to get off free without the fear of the police chasing him. Antony will get that pleasure.

This story is all fiction, it never happened. At least it didn’t happen to Antony because I made him up but it could happen to you.

If you have an arrest warrant you can get arrested at any time

It might be when you get pulled over for a random auto check or you were driving a little too fast. The police will often do a routine check on you and if they find any warrants they will arrest you right there.

If you don’t get arrested like this then sooner or later the cops will come for you and drag you out of your home. They won’t care whether you’re guilty or not. There is a warrant for your arrest and it’s their job to arrest you.
